O presente trabalho tratará a criação intelectual no âmbito de um contrato de trabalho e, por isso, situa-se num ponto de interação entre o Direito do Trabalho e o Direito de Autor. Em particular, cuidará dos problemas de partilha de prerrogativas autorais entre trabalhador e empregador. Dar-se-á ênfase ao momento posterior à cessação do contrato de trabalho, em que o empregador aspira a manter as prerrogativas que adquiriu e o trabalhador a readquiri-las.
This paper addresses the intellectual creation under an employment contract; therefore, it stands in a crossing point between Labour Law and Copyright Law. In particular, we analyze a set of issues arising from the need for distribution of authorial prerogatives between worker and employer. We intend to give special attention to the time after termination of the employment contract, when the employer aims to maintain the prerogatives purchased and the employee aspires to reacquire them.
