Abstract(s)
The present Dissertation intends to study the legal framework of the elderly victims of domestic violence, through a critical analysis of the needed requirement of cohabitation between the elder victim and the crime agent. By trying to define, firstly, what it means to be especially vulnerable due to age by the Portuguese Criminal Law, we will then analyze the al. d), n.º 1 of Article 152.º of CP, namely the obligatoriness of cohabitation between the elderly and their aggressor. We intend, with this study, to demonstrate the still diminished criminal protection of our elderly victims of domestic violence, starting from the cohabitation requirement, required only in the case of particularly vulnerable victims, as a presupposition that creates fragilities for the elderly victims of violence by their relatives, leading them to a double victimization.
