A justiça tradicional que se manifesta, maioritariamente, através de medidas
privativas de liberdade, tem-se verificado ineficaz ao nível da diminuição da taxa de
reincidência e tem apresentado alguns prejuízos, como os custos elevados para o
Estado. Por esse motivo, a literatura tem apontado vantagens de um modelo de
justiça alternativo – justiça restaurativa. Este estudo insere-se no Projeto “Reparation
to the victim in the European Juvenile Justice Systems: Comparative analysis and
transfer of best practices” (REVIJ), que visa criar uma justiça alternativa e/ou
complementar à justiça atual, de maneira a tentar colmatar as limitações existentes
na resolução de crimes. Este estudo explora as perceções de técnicos de apoio à
vítima e técnicos de reinserção social, quanto aos significados e experiências das
vítimas, aquando a sua participação em processos de justiça restaurativa. Para tal,
foram realizadas, transcritas e analisadas entrevistas semiestruturadas a oito
profissionais. Os dados sugerem que a justiça restaurativa é um processo ainda
muito embrionário em Portugal, sendo escassa a experiência dos profissionais, e
insuficientes a formação, os recursos humanos e os materiais para a sua
implementação. Para além disso, os dados revelam que persiste uma cultura de
justiça centrada no ofensor e na sua punição, o que faz com que a vítima não seja
incitada a participar no processo do qual faz parte. Por este motivo, torna-se difícil
extrair conclusões acerca do impacto deste modelo na vítima.
The traditional justice that manifests itself, mainly, through custodial measures, has been ineffectual in terms of reduction in relapse rate, and has had some losses, such as the high costs to the state. For this reason, the literature has shown advantages of an alternative justice model - restorative justice. This study is part of the project "Reparation to the victim in the European Juvenile Justice Systems: Comparative analysis and transfer of best practices" (REVIJ), which aims to create an alternative justice and / or complementary to the current justice, in order to try to bridge the limitations in solving crimes. This study explores the perceptions of victim support technicians and probation officers, as the meanings and experiences of victims, during their participation in restorative justice processes. To this end, there were transcribed and analyzed semi-structured interviews with eight professionals. The data suggest that restorative justice is still very embryonic process in Portugal, with scant experience of professionals, and insufficient training, human resources and materials for their implementation. Furthermore, the data shows that there is still a culture of justice centered on the offender and his punishment, which causes the victim is not induced to participate in the process of which it is part. For this reason, it is difficult to draw conclusions about the impact of this model on the victim.
