No ordenamento jurídico português, por morte de um dos membros da união de facto são atribuídos ao sobrevivo alguns direitos, designadamente o direito a alimentos sobre a herança do falecido, o direito a indemnização por danos não patrimoniais resultantes da morte do unido de facto, o direito de habitação sobre a casa de morada da família e de uso do respetivo recheio e, ainda, o direito a prestações sociais por morte. No presente estudo, conclui-se pela insuficiência desta tutela, sugerindo-se alterações no sentido do seu reforço, tais como a inserção do unido de facto sobrevivo no elenco dos designados legítimos, com precedência em relação aos irmãos e sobrinhos do falecido.
Portuguese law recognizes some rights to the surviving member of the de facto unions, namely the right to maintenance on the deceased's estate, rights to the family home and furnishing, the right to get social benefits on death and also the right to compensation for non-pecuniary damage resulting from the death of the de facto partner. This study concludes that this protection is insufficient and suggests changes to strengthen it, such as including the surviving unmarried partner in the list of legal beneficiaries, with precedence over the deceased's siblings and nephews.
