Abstract(s)
Amparado em análise de doutrina jurídica internacional e jurisprudência, buscou-se demonstrar a complexidade, similitudes e diferenças entre o direito da união europeia e o estadunidense no que diz respeito a perseguição e criminalização de pessoas LGBTQIA no país de origem como requisito para concessão do status de refugiado. Nesse ambiente complexo, além dos critérios usados para o reconhecimento da criminalização, há que se ter uma abordagem multidisciplinar, com base em princípios éticos e medidas educacionais, em detrimento da aplicação legislativa pragmática, a pessoa pertencente ao grupo específico, LGBTQIA, posta no centro da questão.
Supported by an analysis of international legal doctrine and jurisprudence, this work intends to demonstrate the complexity, similarities and differences between European Union and US law with regard to the persecution and criminalization of LGBTQIA people in the country of origin as a requirement for granting refugee status. In this complex environment, a multidisciplinary approach is required, based on ethical principles and educational measures, and it is important to place the person who belongs to the specific group, LGBTQIA, at the center of the issue, ensuring protection.
