Abstract(s)
trabalho visa analisar as legislações do Brasil e de Portugal relativamente aos acidentes de trabalho e doenças profissionais. Por razões de coerência e sustentabilidade sistémica, elegeram-se dois temas centrais: a cumulatividade de indemnizações e o direito de regresso da segurança social. Destacou-se a realidade de um país na análise de cada tema. A pesquisa se fundamentou na análise das legislações desses países e em alguns dados históricos e oficiais.
A interpretação e a aplicação do direito nesses países são diferentes, embora as suas legislações apresentem institutos jurídicos em comum (proibição do enriquecimento sem causa e reparação integral). Concluiu-se que a jurisprudência dominante no Brasil, sobre a cumulação das indemnizações devidas pelo empregador e pela Segurança Social, não está de acordo com o sistema legal vigente. Quanto ao direito de regresso da Segurança Social em Portugal, observou-se a inércia dessa entidade, não obstante exista suporte legal para tanto.
This paper results from the analysis of the laws of Brazil and Portugal regarding occupational accidents and diseases. For reasons of consistency and systemic sustainability, two central themes were chosen: the cumulativeness of indemnities and the right of recovery of social insurance. Only one country was highlighted in the analysis of each theme. The research was based on the analysis of the laws of these countries and on some historical and official data. The interpretation and application of law in these countries are different, although their laws have joint legal institutes (doctrine of unjust enrichment and full compensation). It was concluded that the dominant jurisprudence in Brazil, about the the cumulativeness of indemnities due by the employer and Social Security, is not in accordance with the current legal system. Regarding the right of recovery of Social Insurance, in Portugal, the inertia of this entity was observed, although there is legal support for it.
