Abstract(s)
Com a presente investigação pretende-se estudar a aplicação do artigo 102º do Tratado sobre o Funcionamento da União Europeia a situações verificadas no mercado digital e possíveis problemáticas daí derivadas, focando-se na decisão da Comissão Europeia relativa ao Caso Google Shopping. Deste modo, procuramos evidenciar os aspectos mais controversos desta decisão no que à aplicação do preceito legal diz respeito, nomeadamente a definição do mercado relevante, a caracterização do abuso identificado bem como as medidas correctivas impostas. Posteriormente, face aos elementos expostos é apresentada uma possível distinta abordagem ao assunto considerando diferentes posições adoptadas pela doutrina bem como a apresentação de uma distinta medida corretiva que face aos factos poderia colocar termo ao alegado abuso identificado. Concluiu-se que o motor de busca Google Search reúne os requisitos necessários para ser considerada uma infraestrutura essencial.
In this investigation, we focus on studying the application of article 102º of Treaty on the Functioning of the European Union to situations observed in the digital market and the possible problems originated by that application. With that purpose, we focus on the Commission decision about the Google Shopping Case. We highlight the more controversial aspects of this decision related to the application of the mentioned article, namely the relevant market definition, the abuse described as well as the remedies imposed. Afterwards, considering the elements exposed, we formulate another possible resolution of the problem considering different positions defended by the doctrine. Finally, according with all the facts and opinions exposed we conclude that the general search engine Google Search should be considered an essential facility.
