Abstract(s)
Numa realidade que comporta a disseminação de barreiras entre tempo de trabalho e tempo de descanso, em que se compromete a conciliação da vida profissional e familiar e em que as Novas Tecnologias de Informação e Comunicação são sinónimo de permanente conexão, torna-se pertinente analisar a desconexão: como realidade social, mas essencialmente como realidade jurídica. Desde o direito à desconexão ao dever de abstenção de contacto, este estudo pretende fazer uma análise contemporânea sobre a (des)-conexão, nomeadamente, a nível nacional e atendendo criticamente à mais recente Lei n.º 83/2021 de 06/12 e aos problemas que, na prática, esta acarreta para as relações laborais.
In a reality that involves the dissemination of barriers between working time and resting time, in which the reconciliation of professional and family life is challenged and in which the NICT translates into permanent connection, it is crucial to analyse disconnection: not only as a social reality, but essentially as a legal reality. From the right to disconnect to the duty to abstain from contact, this study intends to make a contemporary analysis of (dis)connection, namely at a national level, while taking into account and analysing in depth the most recent Law n.º 83/2021 and the problems that it entails for labour relations.
