A presente dissertação focar-se-á no regime da responsabilidade civil extracontratual do Estado e demais entidades públicas por funcionamento anormal do serviço. Fruto de desenvolvimento jurisprudencial, a falta do serviço só, recentemente, é alvo de consagração legal, em Portugal, e é construído como um mecanismo que possibilita a responsabilização do Estado e demais entidades públicas nos casos em que não é possível apurar concretamente o agente administrativo responsável. Nestas hipóteses, a responsabilidade do Estado nasce de um resultado atribuível a um funcionamento anormal do serviço que não agiu de acordo com o exigível. É com base neste instituto de inspiração francesa, que tentamos apurar uma eventual responsabilidade estadual em relação aos incêndios de junho e outubro de 2017, em Portugal, que tristemente alcançaram números recorde.
This thesis will focus on the legal system built for the non-contractual civil liability of the State and other public bodies due to an abnormal performance of the services. Developed by the courts, this mechanism has only recently been object of legislation in Portugal and it is built as a method to impute civil liability to the State and other bodies when there is no way of finding out who was the responsible agent. In this cases, the governmental liability is due to a result that shows an abnormal performance of the service that didn’t act as it should. Based on this French-inspired institute, we tried to analyze a possible governmental responsibility for the fires that occurred in June and October in Portugal that sadly reached record numbers.
