O presente trabalho analisa o regime consagrado no artigo 55.º-A do CCP nas suas dimensões substantivas e processuais e a sua relevância. Procura-se explicar os requisitos legais consagrados e a dificuldade da sua aplicação e interpretação e as divergências com as Diretivas de 2014 e a necessidade de interpretação conforme.
This paper concerns to the self-cleaning measures and their insertion in the Portuguese Public Contracts Code, its importance and the difficulties of interpretation. Finally, it tries to verify the respect of the Directives and the possibility of conform interpretation.
