- Responsabilidade civil médica : em especial, a causalidade alternativaPublication . Tavares, Mafalda Nunes Nascimento; Antunes, Henrique Mário Nunes SousaPelo presente estudo, analisaremos e consideraremos três grandes pontos: em primeiro lugar, o instituto da responsabilidade civil médica e os seus pressupostos, em segundo lugar, o pressuposto do nexo de causalidade e as suas fragilidades; em terceiro lugar, a problemática da causalidade alternativa e a sua aplicação no ordenamento jurídico português. No fundo, percorreremos o caminho referido, no sentido de elucidar e evidenciar os desafios com que se depara o paciente lesado, numa acção que pretende a responsabilização civil do médico lesante, nomeadamente no que à prova do nexo de causalidade entre a acção/omissão e o dano por si sofrido diz respeito. Por fim, aludiremos a uma das situações mais complexas, actualmente, em matéria de causalidade, o denominado fenómeno de causalidade alternativa, passível de se verificar no âmbito da prática médica. Procuraremos, assim, não só explanar a temática, mas obter uma resposta para a mesma à luz do nosso sistema jurídico.
- Vodafone : the Importance of Dynamic Capabilities in an Innovative MarketPublication . In the market of the Telecommunications Operators (TelCo’s) everything occurs at a vertiginous speed, making use of the most innovative technologies, implemented in a planetary scale. I trusted that it could be the ideal scenario for my dissertation, whose aim is analysing Competitive Advantage Theories and learning how a market leader does to keep growing and be the most innovator player. The challenges faced by the Global Market will be addressed, in the form of a case study, focusing specifically on Vodafone, one of the largest Telco’s, worldwide, and analysing evidence of how it ensures its competitiveness in the present and projects the future. It is intended that this case study can be used as a teaching tool, providing practical clues from a concrete example, to analyse the strategic structures, their general principles and applicable theories. The case focuses on the analysis of resources and capabilities, taking into account external shocks and internal changes. With the analysis of this case study, I intend to identify evidences that could help to answer to the research question: “What are the unique resources and capabilities that Vodafone possesses that constitute its competitive advantage and in what way did they’ve been developed”.
- Digital transformation in recruitment : best practices in the Portuguese marketPublication . Castro, Bernardo Braga e; Pinho, André de AlmeidaThe “war for talent” is leading organizations to focus on recruitment process agility and employer branding as a way to successfully recruit the best individuals. For this, companies are increasingly turning to implementing new technological developments in their recruitment and selection processes. This dissertation focuses on identifying the impact these technologies can cause, and what the best practices are for implementing them into recruitment processes, from the perspective of the internal recruiters. For this, a qualitative analysis was conducted through researching existing literature and conducting semi-structured interviews with recruiters. The results show that the implementation of automatic CV screening, asynchronous video interviewing and assessment games have a positive impact on recruitment processes, namely through increased accuracy of assessment, shortening the process duration, increasing diversity among recruits and enabling higher candidate pools. Companies are also focusing on increased software integration and gathering of recruitment metrics for continuous process improvement. For the successful implementation of these changes, recruiters see organizational culture as a key factor.
- Ownership vs. sharing economy : the impact on the automotive industryPublication . Sag, Aryo; Conti, RaffaeleWhat is the impact of car sharing services on the automotive industry and in particular on new car sales? Previous literature used surveys to estimate the impact of car sharing services on car ownership. To overcome possible limitations in terms of an inability to test proper causal rela-tionships, a difference-in-difference regression analysis is used to estimate the impact of car sharing services on German new car sales. Yearly data (2008-2017) with the number of car2go and DriveNow car sharing vehicles for seven German cities is used to examine the impact on new car registrations compared to other seven German cities which serve as the control group. I do not find evidence of the impact of car sharing services on new car registrations and hence on new car sales. These results do not go in line with the findings of previous literature which found private car ownership to decrease after the participation in car sharing services. However, I argue that the impact of car sharing services on the automotive industry might be very notice-able in the future. Thus, management implications and recommendations are given in the final chapter.
- The optimal omnichannel strategy for SMEs apparel retailersPublication . Varvello, Carlotta; Pinho, André de AlmeidaThe omnichannel transition took mainly place in big companies within the apparel retailing while in SMEs it was usually performed far less. Multichannel presents a structure of independent different channels, whereas a full channel integration is reached within an omnichannel strategy, which can deliver a seamless customer experience in all touchpoints. Nowadays, customers are more independent than ever, thus the drivers of purchase have changed. Considering this tendency, current academic research about this topic, with the concern of its implementation in smaller apparel retailers, is limited. The thesis aims to analyze the current condition of channel strategies in the apparel retailing, mostly in Italy and Portugal, to build an implementation process for an omnichannel shift for multichannel apparel of SME’s retailers, as well as its main characteristics. Therefore, qualitative research was conducted through the analysis of 14 semi-structured interviews with four different categories in the apparel industry. The findings show that small apparel retailers have not developed this strategy yet because of the fear of uncertainty, lack of consumer knowledge, inefficient warehouse and inventory management, and basic knowledge concerning the topic. Hence, it was concluded that omnichannel is a customer-oriented strategy in which elements of the marketing mix need to be aligned to guarantee a unified offer regarding communication and availability. This is reachable only through a cloud-based operation system and logistic partnerships. Lastly, SMEs can pursue this transformation by following a seven-step approach that requires long term vision and investments in digitalization.
- Mutilação genital feminina como violação dos direitos da criança : a proteção da criança no ordenamento jurídico português e guineensePublication . Sanhá, Sandra; Ferreira, Maria Elisabete da CostaO presente trabalho debruça-se sobre a análise comparativa dos direitos da criança nos ordenamentos jurídicos português e guineense, tendo como enfoque os modelos de proteção e promoção da menor perante a prática de ablação dos órgãos genitais femininos, atualmente denominada de mutilação genital feminina. Esta prática ancestral fortemente enraizada na cultura guineense e hoje disseminada por todo o mundo é reconhecida pelo direito internacional como uma gritante violação dos direitos da mulher e da criança, visto que as suas sequelas afetam de forma grave a saúde e a integridade física das suas vítimas, que geralmente são crianças. No entanto, entendido por alguns autores como um crime culturalmente motivado, a mutilação genital feminina é um tema simultaneamente complexo e controverso, dados os fundamentos que o instituem. Entre muitas, esta prática encontra a sua justificação na tradição e na cultura. Assim sendo, partindo destas premissas, o presente trabalho pressupõe-se analisar a efetividade da proteção da criança contra a mutilação genital feminina nos ordenamentos jurídicos português e guineense. Preliminarmente, procedemos a um enquadramento geral dedicado à mutilação genital feminina e a toda a sua implicação psicossocial, avançando seguidamente para a análise dos tratados internacionais que tutelam a proteção da menor perante este flagelo que afeta mais de 200 milhões de mulheres e raparigas em todo o mundo. Em seguida, observamos a conceção e evolução dos direitos da criança, bem como o relevante papel do Estado para a positivação constitucional deste direito em ambos os países. Por fim, observando o quadro jurídico dos referidos países, suscitamos a seguinte questão: “será o direito português um modelo a seguir?”
- The impact of machine learning on the efficiency of the B2B sales service in pharmaceutical companiesPublication . Brengel, Tobias; Pinho, André de AlmeidaThe explanatory study examines the possible value of Machine Learning in the B2B sales process in pharmaceutical companies. Sales representatives accounting for a wide range of activities, suffering from time consuming and repetitive tasks. This study investigates the potential of Machine Learning applications for B2B sales in order to facilitate sales representative’s daily tasks and enhance the entire sales process. The results have been obtained through qualitative research based on 8 interviews with AI-experts, pharma consultants and sales representatives as well as secondary data in form of academic articles and reports. The findings reveal that, compared to other departments, ML-applications in B2B sales are less applied at the current stage, but mostly in the customer service process. The interviews have shown that the usage of ML-applications is possible within all steps of the sales process and enhances its overall efficiency and effectivity in terms of time, costs and quality. Furthermore, tasks which increase the efficiency of the sales department through ML applications are outlined. By applying ML within the B2B sales process, the daily work of sales representatives can be facilitated, which ultimately could not only have a positive impact on customer satisfaction, but also on employee commitment leading to competitive advantage in the price intense environment of the pharmaceutical industry.
- Nearshoring to emerging European markets : an analysis of the automotive industryPublication . Leitão, João Corte-Real Morais; Pinho, André de AlmeidaThe European Emerging Markets are in the process of consolidation of their economies since the liberation from the Soviet Bloc. The EU accession and a combination of low wages and skilled labor facilitated the inclusion of these countries in global value chains. This study focuses on the automotive industry and examines the solution of nearshoring production to the European Emerging economies. Supported by quantitative and qualitative data, this study expects to formulate valuable strategic recommendations for European-based companies, by identifying the optimal market to nearshore, as well as the appropriate market entry strategy. An empirical tool was developed to aggregate and ease the interpretation of the data gathered, exhibiting its results thru the interception of two dimensions: the accessibility to enter a market; and the conditions to prosperity provided by it. The results generated by the matrix point to Czech Republic as the most attractive markets to nearshore, and companies should employ a wholly-owned entry strategy.
- The future of the healthcare industry : how will digital transformation create better healthcare?Publication . Torres, Madalena Marçal Teixeira Furtado; Pinho, André de AlmeidaThis dissertation focuses on the analysis of the opportunities raised by emerging tech dynamics to improve care delivery. Specifically, it focuses on assessing its impact in the main healthcare activities covered in the prevention and diagnosis stages through the lens of three main stakeholder groups - the patients, the health professionals and the health service’s experts. In order to reach these objectives, an exploratory and qualitative research was conducted through the analysis of primary and secondary data, collected from existing literature and semi-structured interviews with the considered stakeholder groups. The conclusions suggest that tech dynamics can bring significant impact to the healthcare industry through three main key applications: (1) information generation, which have a major impact in the activities covered in the prevention stage; (2) information treatment, impacting both activities covered in prevention and diagnosis; and (3) experience improvement, mainly useful in activities that require in person interactions. By applying the tech dynamics into medical practice, the stakeholders may benefit from enhanced user experience, productivity and cost reductions which ultimately has a positive impact into the improvement of the quality of care delivered. Moreover, this impact is extended through other stakeholders in the life-science such as insurance companies and pharmaceuticals.
- SCO technology in grocery retailing : a structured analysis of current SCO systems from a customer and retailer perspectivePublication . Wilk, Gregor; Pinho, André de AlmeidaThis disertation presents an analysis of the customer and retailer value of SCO technologies in grocery retailing. The increasing competition, such as discounters or online channels, has led to a decrease in growth and profitability for traditional retailers. In order to counteract these increasing problems, retailers have been experimenting with SCO systems to save operating costs and to enhance customer satisfaction. However, research does not indicate that the deployment of various SCO instantly leads to such benefits and emphazises additional risks both for the retailers and customers. Thus, it is necessary to further analyse the impact of SCO devices on the retailer as well as the technology characteristics that drive consumer adoption. In order to destinguish the overall value for each SCO technology, a mixed-methods design is applied where qualitative data is quantized based on a Simple Multi-Attribute Rating Technique. Consequently, the first part of the analysis defines the individual weight and the score of each SCO variable that represents a key driver towards customer adoption. In the second part, the retailer value gets evaluated and added to the following calculation in order to define the definite SCO value. The “Scan Gun” offers the optimal mix of customer and retailer value and slightly outscores the Mobile Scan and Go technology via smartphone by achieving a total value of 15.11 out of 20 points.
