Abstract(s)
Com esta dissertação, propomos a análise observatória e crítica de um tema cuja importância começou a manifestar-se, e tem vindo a aumentar nos últimos anos. A novidade tecnológica consegue criar novas realidades, inclusive no mundo do Direito, e em específico no mundo do Direito Contratual. Claro está, estas novas realidades não vêm sem as suas próprias, particulares, complicações, as quais nos propomos a desmistificar à luz do Direito Contratual Português. Através da análise da moldura legal do Direito Contratual, o panorama internacional e as principais problemáticas associadas aos contratos inteligentes, expomos assim os problemas que se mantêm, ou que são passíveis de encontrar solução nas normas contratuais já existentes. Ou, ainda, nem existentes, mas que certamente surgirão. Concluímos a dissertação com uma defesa rígida deste tipo contratual e uma acérrima defesa em prol de uma regulação célere, mas focada na parte basilar dos Smart Contracts, com o objectivo de atingir uma harmonia legal a nível europeu e promover o comércio jurídico em Portugal.
With this thesis, we propose the observatory and critical analysis of theme which importance already started manifesting, and has been rising for the last few years. The new technological advancements can create new realities, including in Law, and specifically in Contract Law. But of course, these new realities don’t come without their proper, particular, complications, which we propose to unravel in the light of the Portuguese Contract Law. By analysing the legal framework of Contract Law, the international panorama, and the main issues associated with Smart Contracts, we can expose the problems that stick, or can be found a solution for, in the already existing norms. Or, even, that don’t exist, but certainly will. We conclude this dissertation with a strong defense in favor of this type of contract, and an obstinate defense towards a fast regulation, but focused on the basics of the Smart Contracts, with its main goal of reaching European harmony and promote legal trade.
