Abstract(s)
A presente dissertação visa evidenciar o potencial conflito que pode surgir entre os direitos dos pais, enquanto titulares das responsabilidades parentais e primeiros e principais cuidadores dos seus filhos, e os direitos da criança, enquanto verdadeiro sujeito de direitos fundamentais, dotado de uma autonomia progressiva.
Destacamos, para o efeito, a importância do princípio do superior interesse da criança, princípio orientador de todo o processo de promoção e proteção de crianças e jovens em perigo e critério prioritário que deverá nortear todas as questões que digam respeito à criança, representando um objetivo a prosseguir não apenas por todas as pessoas que lidam diariamente com crianças, especialmente os seus progenitores, mas igualmente pela sociedade e pelo Estado, que têm o dever de as proteger, com vista ao seu desenvolvimento integral.
Procedemos, por fim, a uma análise crítica do Caso Pontes contra Portugal, com o propósito de demonstrar a dificuldade em, por vezes, atingir um justo equilíbrio entre os direitos dos pais em relação à educação e manutenção dos filhos e os direitos da criança e o seu superior interesse, sendo que é necessário analisar a situação específica de cada criança, nomeadamente os vínculos afetivos que a ligam à sua família biológica e o ambiente familiar em que se encontra inserida.
The present dissertation aims to emphasize the potential conflict that may arise between parent’s rights, as holders of the parental responsabilities and the first and main caregivers of their children, and the rights of the child, as a true subject of fundamental rights with progressive autonomy. We highlighted, for this purpose, the importance of the principle of the best interest of the child, which is the guiding principle of the whole process of promotion and protection of children and adolescents in danger and a primary criterion that should guide all matters affecting the child, representing a goal to be pursued not only by all those who deal with children on a daily basis, especially their parents, but also by society and the State, who have the duty to protect them in order to ensure their integral development. Finally, we proceeded to a critical analysis of the Pontes against Portugal Case, in order to demonstrate the difficulty in, sometimes, achieving a fair balance between parent’s rights regarding the education and support of their children and the rights of the child and it’s best interest, making it necessary to analyze the specific situation of each child, particularly the affective bonds that bind it to its biological family and the family environment in which it is inserted.
