Numa época em que a economia digital ganha cada vez maior importância, torna-se evidente a necessidade de análise e estudo dos mercados que a caracterizam e do quadro legal que a envolve. Como tal focamos a nossa investigação nos desafios que os mercados digitais levantam no âmbito do Direito Europeu da Concorrência. Através da análise das recentes Decisões da Comissão nos Casos Google, percebemos o impacto das características dos mercados digitais na definição de mercado relevante e posição dominante, determinação do tipo de abuso e medidas corretivas plausíveis. Concluímos que o Direito Europeu da Concorrência se mantém como adequado para dar resposta aos desafios que estes mercados levantam, não obstante ser necessário adaptá-lo e flexibilizá-lo, atendendo às características específicas dos mercados digitais.
At a time when the digital economy is becoming increasingly important, there is a clear need for analysis and study of the markets that characterize it and the legal framework that surrounds it. Therefore, we focus our research on the challenges that digital markets raise under European Competition Law. By analyzing recent Commission Decisions in Google Cases, we realized the impact of digital market characteristics on relevant market definition and dominance, determination of the type of abuse and plausible remedies. We conclude that European Competition Law remains adequate to meet the challenges that these markets raise, although it needs to be adapted and made more flexible, taking into account the specific characteristics of digital markets.
