Abstract(s)
O emergente comércio internacional tornou necessária a criação de uma garantia das obrigações dotada de maior segurança, eficácia e de execução célere. Assim nasceu a garantia autónoma, em meados do século XIX. A garantia autónoma é uma garantia pessoal das obrigações, todavia, não encontra previsão legal, é uma figura de pura criação social. Sendo uma garantia pessoal, esta distingue-se da fiança por não ser uma garantia acessória, mas sim autónoma relativamente à relação garantida. Assim, no presente trabalho, debruçar-nos-emos sobre a problemática da transmissibilidade da garantia autónoma em caso de cessão do crédito garantido, de cessão da posição contratual e, por último, sobre a possibilidade (ou não) da sua transmissão isolada.
The growing international trade made it necessary to create a guarantee of obligations with greater security, efficiency and of rapid execution. This way, autonomous guarantee was born in the middle of the nineteenth century. Autonomous guarantee is a personal guarantee of obligations. However, it does not have legal provision, being a figure of pure social creation. Being a personal guarantee, it distinguishes itself from the bail, as it is not an accessory guarantee but autonomous relatively to the guaranteed relation. This way, in this piece of work, we will focus on the issue of transmissibility of autonomous guarantee, in case of credit assignment, of contractual position assignment and, at last, on the possibility (or not) of isolated transmission.
