O estudo que elaboramos versa sobre o instituto do segredo de negócio. A opção por este tema resulta, em larga medida, da publicação da Diretiva (UE) 2016/943 do Parlamento Europeu e do Conselho de 8 de junho de 2016. Assim, começaremos por abordar a discussão quanto à importância de tal instituto e à sua atualidade, passando de seguida a uma análise da sua evolução histórica, conceito e regime jurídico, tanto a nível internacional como nacional, fazendo também um estudo de direito comparado. Por fim, faremos uma breve análise da supra indicada Diretiva, enquanto diploma que irá promover alterações de relevo na matéria, sua transposição e eventuais conflitos com o ordenamento jurídico português.
The study that we elaborate is about the trade secrets. The option for this theme results to a large extent from the publication of Directive 2016/943 of the European Parliament and of the Council of 8 June 2016.Thus, we will start by discussing the relevance of trade secrets, going on to an analysis of their historical evolution, concept and legal regime, both internationally and nationally, as well as a comparative law study. Finally, we will make a brief analysis of the mentioned Directive, as an act that will promote important changes in the matter, its transposition and possible conflicts with the Portuguese legal system.
