O contrato de trabalho doméstico é um contrato de trabalho especial regulado pelo Decreto-Lei n.º 235/92, de 24 de outubro. No domínio laboral, a interpretação e aplicação deste regime especial tem-se revelado problemática, em grande parte indiferença do legislador, manteve aquele regime estático no tempo, apesar das várias alterações ao Código de Trabalho. Dada a impossibilidade de analisar todo o diploma, restringimos às questões de cessação do contrato de trabalho doméstico, em que, no nosso entendimento, se nota a maior desproteção destes trabalhadores, podendo-se até falar em discriminação. Neste sentido, o objetivo da presente dissertação é de analisar criticamente o regime atual, e verificar se as razões que motivaram este regime realmente o justificam, se se justifica aquela desproteção, ou se é necessária a sua revisão.
The domestic service contract is a special employment contract which is regulated by Statue no 235/92, enacted in October 24th. In the labor domain, the interpretation and application of that regulation has been a source of doubts and uncertainty, mainly due to the indifference of the legislator, that keeps that regulation static in time, although the Labour Code has been often amended. Since it is impossible to analyze the whole Statute, we restricted to the questions regarding the dismissal of this special service contract, the field in which the lack of protection of these employees, or even discrimination, is quite evident. With this in mind, the purpose of the work here presented is to assess the current regulation, and check if the reasons that motivate this special regime still justify it, or if an amendment is necessary.
