Abstract(s)
A presente dissertação tem como objetivo estudar a história da pena de prisão e perceber porque
é que, ainda hoje, se trata da pena de eleição do Direito Penal.
Para tal, o presente trabalho apoia-se no pensamento de Michel Foucault e, essencialmente, na
sua obra Surveiller et Punir. Confrontados com o caráter de “evidência” e as falhas que,
segundo este autor, a prisão apresenta desde as suas origens, interrogar-nos-emos sobre o
porquê desta evidência e se será possível, nos dias de hoje, ultrapassá-la para conseguir
encontrar uma alternativa viável.
Recorreremos assim à linguística jurídica e, principalmente, ao trabalho de Gérard Cornu e
Edward Sapir. Concluiremos que para conseguir sequer conceber uma alternativa à pena de
prisão, será necessário reformar a linguagem do Direito e permitir a sua abertura a novos
conceitos, lógicas e interlocutores.
This thesis aims to study the history of legal imprisonment and to understand why, even today, it is the penalty of choice of criminal law. To this end, the present work is based on the thought of Michel Foucault and, essentially, on his book Surveiller et Punir. Confronted with the character of "evidence" and the flaws that, according to this author, prison presents since its origins, we will reflect on the reasons why it is evident and whether it is possible, today, to overcome it and find a viable alternative. We will thus make use of legal linguistics and, mainly, the work of Gérard Cornu and Edward Sapir. We will conclude that in order to be able to devise an alternative to imprisonment, it will be necessary to reform the language of the law and to open it up to new concepts, logics and interlocutors.
