Abstract(s)
No âmbito do Direito do trabalho vigora o princípio geral da proibição de cedência de trabalhadores. Esta é vista como um atentado ao princípio basilar de que a relação laboral é pessoal e de que o trabalhador não é uma mercadoria, só sendo admissível em casos excecionais, de forma ocasional e temporária. Releva para efeitos da presente tese a configuração geral e análise de todo o instituto da cedência ocasional de trabalhadores com o escopo de identificar as incertezas, imperfeições e obscuridades do respetivo regime jurídico, assim como as potenciais soluções suscetíveis de assegurarem uma adequada tutela juslaboral dos valores em causa. Acresce que este instituto jurídico, apesar de se configurar como um desvio ao tradicional contrato de trabalho, constitui uma importante ferramenta de mobilidade interempresarial com inúmeras vantagens, o que justifica uma investigação dirigida a avaliar se o âmbito da cedência tem potencialidades expansivas a outras realidades, sem que tal implique uma utilização desresponsabilizada da figura e em fraude à lei.
In the field of labor Law, the general principle of the prohibition of transfer of workers prevails. It is seen as an attack to the fundamental principle that the labor relationship is personal and that the worker is not a commodity, being admissible only in exceptional cases, occasionally and temporarily. For the purposes of this dissertation, is relevant the general configuration and analysis of the entire institute of occasional assignment of workers. The dissertation will explore the uncertainties, imperfections and obscurities of the respective legal regime, as well as the potential solutions that may ensure an adequate legal protection of the values concerned. Moreover, although this legal institute is a departure from the traditional employment contract, it is an important tool for inter-company mobility with numerous advantages identified in our work, which justifies an investigation aimed at assessing whether the scope of the assignment has expansive potential to other realities, without implying unreasonable use of the figure and in circumvention of the law.
