Abstract(s)
A presente dissertação debruça-se sobre a problemática que rodeia a compensação das sequelas corporais graves provindas dos acidentes de viação. O objetivo central é o de explanar um adequado tratamento compensatório a atribuir às incapacidades permanentes, elucidando-se para as várias camadas de proteção exigidas pelos lesados profundos. Para tal, faz-se uso de um método analista, que compreende uma decomposição doutrinal e jurisprudencial relevantes nesta matéria. Assim, o trajeto desta investigação apela, sobretudo, a critérios casuísticos, de bom-senso e de justeza, pelo que o desfecho culmina num aperfeiçoamento das compensações a atribuir às vítimas imediatas e mediatas de lesões corporais graves (não mortais).
The present master’s dissertation focuses on the issues surrounding the compensation of the serious body sequels resulting from traffic accidents. The target of this approach is the explanation of an adequate compensatory treatment to be attributed to permanent disabilities, the clarification of the various layers of protection required by profoundly injured people and what kind of protection do each layer requires. So that can be possible, is used an analytical method that embraces a doctrinal and jurisprudential relevant analysis to this matter. Therefore, this investigation appeals, above all, to casuistic, common sense and fairness criteria, so that the outcome culminates in an improvement of the compensation to be attributed to the immediate and mediate victims of serious (non-fatal) body injuries.
