Abstract(s)
Esta dissertação visa avaliar se a violação de normas jurídicas pode configurar um ato concorrência desleal. Começamos por analisar criticamente o regime geral daquele instituto, ponderando a sua teleologia, os interesses jurídicos que tutela, os seus requisitos e as divergências que na matéria entre nós persistem. De seguida, de forma mais concreta e dirigida ao tema em estudo, reúnem-se as soluções já oferecidas pela doutrina nacional, as parcas soluções que resultam da jurisprudência e breves referências de Direito Comparado. Acaba por ser conclusão que a resposta é positiva, apesar de estar reservada a situações que preencham cumulativamente diversos pressupostos que resultam da cláusula geral.
This dissertation aims to evaluate if the violation of legal norms can also configure an act of unfair competition. To reach a conclusion, we will start with a critical analyze of the general regime of that institute, considering its teleology, the legal interests that it intents to protect, its requirements and the differences that persist among us. Then, more specifically onto the subject in analyses, we will gather the different solutions already offered by the doctrine, and also the lack of national case law solutions and finally, some brief references in the Comparative Law. In fact, and by the end, the answer will be positive, in spite of being reserved for situations that, cumulatively, fulfill the several requirements of the general clause.
