A prescrição off-label de medicamentos consiste no uso de um fármaco para além das indicações constantes no Resumo das Características do Medicamento, relativamente ao grupo populacional a que se destina, à dosagem ou via de administração, bem como na sua utilização para o tratamento de patologias diferentes das inscritas na Autorização de Introdução no Mercado. Esta é uma prática amplamente aceite pela comunidade médica, uma vez que se traduz, por vezes, no melhor tratamento possível a aplicar ao paciente e encontra justificação no princípio da liberdade terapêutica. A presente dissertação visa explorar os problemas com que se depara esta prática, devido, principalmente, à parca regulamentação existente. Aprofundar-se-ão os conceitos próximos da prescrição off-label, bem como a responsabilidade civil e criminal do médico prescritor.
Off-label prescription consists on the of use a drug outside its indications, in relation to the population group for which it is intended, dosage or way of administration, as well as its use for different pathologies other than the ones for which it was authorized. This practice is widely accepted by the medical community as it, sometimes, translates into the best possible treatment to the patient and finds justification in the principle of therapeutic freedom. The purpose of this thesis is to explore the problems encountered by this practice, mainly due to the lack of existing regulation. Close concepts to off-label prescription will be explored, as well as civil and criminal liability of the prescribing doctor.
