Abstract(s)
A evidência científica aponta cada vez mais no sentido de que nos encontramos no advento da
era dos melhoramentos genéticos aplicados à capacidade cognitiva.
As consequências de um avanço tecnológico rápido e não regulado podem ser potencialmente
catastróficas, ao ponto de alterar definitivamente a existência dos seres humanos.
Por estes motivos, o esforço regulatório é urgente e complexo: enormes desafios se afiguram
no domínio da ética e da moral bem como na sua compatibilização com uma estrutura
regulatória ágil e capaz de dar resposta a este avanço tecnológico em tempo útil.
Na presente dissertação apresentarei alguns caminhos possíveis para que se inicie este esforço
normativo, bem como uma sugestão de uma base de princípios que confira ao Direito a
agilidade necessária para dar uma resposta atempada ao surgimento dos procedimentos
conducentes a melhoramentos cognitivos.
Scientific evidence shows that we’re headed to the advent of the age of genetic enhancements applied to human cognitive abilities. The consequences of this rapid technological advancement, if kept unregulated, could be potentially catastrophic – to the point of definitively changing human existence. For this reason, a regulatory effort is urgent and complex. Great challenges arise from the domains of ethics and morals as well as regarding their compatibility with a regulatory framework that can give a timely and effective response to this technological advancement. In this dissertation I shall present a few possible pathways for this regulatory effort to start taking place, as well as a suggestion for a framework of principles that may enable the legal system to provide a timely answer to cognitive enhancements.
