O presente estudo foi realizado no âmbito da Dissertação de Mestrado em Direito Administrativo da Universidade Católica Portuguesa, Centro Regional do Porto, tendo sido orientada pelo Professor Doutor Mário Aroso de Almeida, e propondo-se abordar um dos mais conturbados temas na área da contratação pública: a dita contratação in house. A cooperação entre entidades adjudicantes assume hoje um papel verdadeiramente fundamental. Num momento de profunda contenção financeira, as relações desenvolvidas no seio do setor público devem procurar maximizar as respostas aos apelos convocados pelo interesse público, bem assim, evitar a procura no mercado privado de soluções que a Administração Pública, latu sensu, pode encontrar em si mesma. Ora, sem esquecer as necessárias dinâmicas de mercado – cuja imperatividade decorre, em primeira linha, dos próprios Tratados da União Europeia –, a nossa análise versará sobre as relações in house e as diversas modalidades da sua constituição, enaltecendo a função fundamental das instâncias europeias (mormente, do Tribunal de Justiça da União Europeia) para o seu desenvolvimento. Por fim, importará incorporar as novidades trazidas pela recente positivação desta exceção ao âmbito de aplicação das regras, comunitárias e nacionais, em matéria de contratação pública, cujo teor não se limitou a reproduzir os sucessivos ensinamentos da Jurisprudência, indo mais além em muitos (quiçá demasiados) aspectos.
This Master Dissertation in Administrative Law at Universidade Católica Portuguesa, Centro Regional do Porto, was carried under the guidance of Professor Dr. Mário Aroso de Almeida and sheds new lights on one of the most controversial topics within public procurement: the in house exception. Nowadays, the cooperation between contracting entities retains a truly fundamental role. In a time of deep financial restrains, relationships developed within the public sector should maximize the requests of public interest, avoiding therefore turning to the private sector in search of solutions that Public Administration, latu sensu, can find within itself. Keeping in mind the market dynamics – whose compulsory requirements mainly descends from the European Union Treaties – our analysis will take on the in house relationships and the many categories of its constitution. At last and regarding the rules appliance, it’s important to integrate the new issues that arise from the recent regulation of this exception concerning public procurement, both at community and national level. Their content does not solely depict the successive lessons from case law and goes further in many, perhaps too much, aspects.
