O âmbito pessoal das convenções coletivas de trabalho é determinado pelo princípio da (dupla) filiação, ficando reservado aos trabalhadores filiados nas associações sindicais outorgantes e aos empregadores outorgantes das mesmas, ou filiados nas associações de empregadores signatárias. No entanto, são várias as exceções admitidas a esta regra. A presente dissertação irá incidir numa destas exceções – o art. 497.º CT – e as consequências que podem decorrer desta extensão dos efeitos da convenção coletivas de trabalho a trabalhador não filiado em associação sindical, por sua própria iniciativa, sobretudo perante a liberdade sindical, um direito fundamental e basilar da nossa sociedade, visto como condição e garantia da construção da unidade dos trabalhadores.
The personal scope of collective labor agreements is determined by the principle of (double) affiliation, being reserved for workers affiliated to the signing trade union associations and to the employers who signed them, or members of the signatory employers' associations. However, there are several exceptions allowed to this rule. This dissertation will focus on one of these exceptions – art. 497.º CT – and the consequences that may arise from this extension of the effects of collective agreements to workers who are not members of trade unions, on their own initiative, especially towards freedom of association, a fundamental and basic right of our society, seen as a condition and guarantee for the construction of workers' unity.
