Com a presente dissertação pretende-se uma reflexão acerca das portarias de condições de trabalho, como fontes específicas de Direito Laboral, especialmente no quadro da sua subsidiariedade, já que motivada por razões extraordinárias de ordem social e económica. Para o efeito, procede-se ao enquadramento normativo do instituto, discutindo as razões que levam à sua emissão, bem como dos motivos que levaram a consagração deste mecanismo no âmbito do nosso sistema de regulamentação coletiva do trabalho. É igualmente nosso objetivo, na presente análise, discutir a (in)constitucionalidade das portarias de condições de trabalho, procurando encontrar os melhores argumentos que, em concreto, nos possibilitem alcançar as melhores soluções paras as dúvidas que foram suscitadas a esse respeito.
This master’s dissertation has the aim of providing an overview of the ordinances on labor conditions, as well as its relationship with the Portuguese collective bargaining system. To that end, the most important legal provisions will be discussed and the requirements for the validity of such an ordinance will be addressed. Moreover, throughout our analysis, the conformity of the ordinances with the Portuguese Constitution will be dealt with, as the grounds for possible invalidities or unconstitutionalities are at the center of our discussion. Our reasoning will be mainly based on a balancing exercise as between the constitutional values at stake.
