| dc.description.abstract | A presente dissertação aborda a possibilidade de um «juiz autómato». Os desenvolvimentos tecnológicos recentes em inteligência artificial trouxeram-nos a possibilidade de automatizar a atividade judicial, exigindo uma investigação pormenorizada sobre o funcionamento dos sistemas de inteligência artificial e a sua capacidade de reproduzir eficientemente o raciocínio judicial. Assim, as perguntas a que se pretende responder são: será o Juiz autómato possível? Como podemos então replicar o raciocínio judicial de forma fiel? Para alcançar uma resposta, investigaremos os diferentes elementos do raciocínio judicial, começando por uma investigação sobre os seus pressupostos (nomeadamente a linguagem e a lógica). Depois, partiremos para a reconstrução autómata da premissa normativa, desde as operações de seleção dos factos à linguagem da decisão judicial. Esperamos que esta monografia se traduza num contributo útil para o melhor entendimento destas novas tecnologias e sua relação com o Direito, bem como no fomento da curiosidade sobre esta nova realidade. | pt_PT |
| dc.description.abstract | The following dissertation addresses the possibility of an «Automated Judge». The recent technological developments on artificial intelligence brought us the possibility of automatizing the judicial activity, demanding an in-depth investigation on these new systems’ functioning and their ability to efficiently reproduce a judicial argumentation. So, the questions at hand are: Is an automated judge possible? Then, how can we accurately emulate the judicial thought process? To reach an answer, we´ll focus at first on the different elements of judicial reasoning, beginning with its assumptions (language and logic). Then, we´ll discuss the automated reconstruction of the normative proposition, from the facts’ selection to the judicial decision discourse. We hope this dissertation will translate in a useful contribution for the better understanding of these new technologies and their relationship with the Law, as well as foster the curiosity for this new reality. | en |
