Nos tempos atuais, a rapidez e a capacidade de resposta são fatores decisivos para o sucesso empresarial. No entanto, a busca desenfreada por essas metas pode levar a excessos na utilização de recursos humanos, ultrapassando limites e direitos constitucionalmente consagrados. Com efeito, com o uso crescente das NTIC, os trabalhadores têm tido dificuldade em se desconectar do trabalho, estando constantemente conectados e contactáveis. Neste contexto, surgiu a necessidade de consagrar expressamente o direito à desconexão, que entre nós se encontra consagrado enquanto “dever de abstenção de contacto”, em contraste com os demais ordenamentos jurídicos. A questão primordial deste trabalho reside na análise da efetividade da consagração do direito à desconexão, com vista a determinar se a sua positivação em Portugal é suficiente ou se, através da adoção de outras medidas inspiradas em ordenamentos jurídicos estrangeiros, se poderia garantir melhor a sua efetividade.
In current times, speed and responsiveness are decisive factors for business success. However, the unbridled pursuit of these goals can lead to excesses in the use of human resources, exceeding limits and constitutionally enshrined rights. Indeed, with the increasing use of NICT, workers have found it difficult to disconnect from work, being constantly connected and contactable. In this context, the need arose to expressly enshrine the right to disconnect, which among us is enshrined as a “duty to abstain from contact”, in contrast to other legal systems. The primary issue lies in analyzing the effectiveness of enshrining of the right to disconnection in Portugal, with a view to determining whether it is sufficient or whether, through the adoption of other measures inspired by foreign legal systems, its effectiveness could better guaranteed.
