Abstract(s)
A presente dissertação ocupa-se da temática da contratação pública ecológica, com o principal propósito de aferir da compatibilidade das soluções protagonizadas pela Resolução do Conselho de Ministros n.º 132/2023, de 25 de outubro, com o Direito da União Europeia. Partindo de um exercício comparatístico das diferentes soluções adotadas pelo ordenamento jurídico de outros Estados-membros, e de uma análise crítica das opções acolhidas pelo Conselho de Ministros, pudemos concluir pela desconformidade de algumas delas para com o Direito da União Europeia, em especial, o princípio da concorrência. Nessa medida, procuramos, na fase terminal da nossa análise, contribuir para a identificação daquelas que defendemos ser as soluções que melhor se coadunam com o nosso ordenamento jurídico, em especial, o Código dos Contratos Públicos, e com aquela que é a realidade técnica e financeira dos operadores económicos que operam no mercado nacional e transnacional.
The present dissertation focuses on the theme of ecological public procurement, with the main purpose of assessing the compatibility of the solutions provided by the Resolution of the Council of Ministers No. 132/2023, dated October 25th, with European Union law. Through a comparative exercise of the different solutions adopted by the legal systems of other Member States, and a critical analysis of the options embraced by the Council of Ministers, we were able to conclude that some of them are not in compliance with European Union law, especially the principle of competition. Thus, in the final phase of our analysis, we seek to contribute to the identification of those solutions that we argue are best aligned with our legal system, especially the Public Contracts Code, and with the technical and financial reality of economic operators taking part in the national and transnational market.
