| dc.description.abstract | A presente dissertação visa transportar a discussão em torno das tecnologias de contabilidade distribuída (máxime, as tecnologias Blockchain) para o plano jurídico. Atendendo aos recentes fenómenos de generalização e desenvolvimento, as tecnologias blockchain hoje extravasam o domínio das criptomoedas. De facto, a importância central do tema no presente gira em torno das várias oportunidades de inovação apresentadas por estas tecnologias, transmutando assim um debate tradicionalmente tecnológico e económico num importante problema jurídico. Ao longo da nossa demanda, propomo-nos estudar os princípios e objetivos subjacentes a estas tecnologias, o percurso trilhado desde a sua génese, bem como os aspetos e concretizações que a enformam na atualidade. Seguidamente, debruçar-nos-emos sobre problemas jurídicos concretos que as tecnologias blockchain se propõe a resolver, com especial incidência sobre o mundo jurídico-financeiro e jurídico-empresarial, analisando criticamente cada um deles. Por fim, trataremos os principais obstáculos que a implementação destas soluções atualmente enfrenta, opinando quanto ao seu peso relativo e possíveis soluções. Ao longo de toda a dissertação deixaremos vincada a nossa posição quanto ao tema em geral e a aplicações específicas que consideremos relevantes ou de potencial relevo para o mundo jurídico. | pt_PT |
| dc.description.abstract | The present dissertation intends to transport the discussion involving distributed ledger technologies (especially, blockchain technologies) to the legal realm. When taking into account the recent phenomena of generalization and development, it becomes clear that blockchain technologies have surpassed the domain of cryptocurrency. In fact, the main relevance of our study revolves around the opportunities for innovation presented by the aforementioned technologies, which converts a traditionally technological and economical debate into an important legal matter. Throughout our demand, we will conduct a study regarding the principles and objectives underlying these technologies, the path taken since its genesis, as well as the aspects and applications that shape it today. Subsequently, we will look into concrete legal issues that blockchain technologies are trying to solve, with special focus on both the financial sector and the business world, analysing each of them critically. Finally, we will address the main obstacles hindering the implementation of these solutions and give our opinion as to what their relative weight and possible solutions might be. Throughout our work, we will highlight our position on the subject in general, as well as on any specific applications that we consider relevant or of potential relevance from a legal point of view. | pt_PT |
