No presente estudo, o foco incidirá sobre o processo extraordinário de viabilização de empresas – PEVE, adicionado ao ordenamento jurídico português pela lei 75/2020. Descreveremos este novo instrumento de recuperação de empresas e indicaremos lacunas existentes e a forma de preenchê-las, bem como críticas sobre sua pertinência. Faremos um paralelo com o processo especial de revitalização – PER.
In the presente study the focus will be on the enterprises viability extraordinary procedure – PEVE, added to portuguese legislation by the law nº 75/2020. We´ll describe this news enterprises recovery instruments and show blanks to be filled and the way to fill it, as well about it´s relevancy to portuguesa law. We´ll compare this new instrument with the revitalization special procedure – PER.
