Abstract(s)
A tramitação do processo de inventário em sede judicial sempre foi alvo de duras críticas, designadamente por se revelar particularmente moroso, prejudicando a tutela jurisdicional efectiva e em tempo útil dos envolvidos na partilha. No âmbito da liberdade de conformação legislativa do legislador, este entendeu que a melhor decisão para acautelar os direitos e garantias dos cidadãos e para potenciar a celeridade processual, seria entregar a condução dos processos de inventário aos cartórios notariais.
O objecto do nosso estudo é a partilha consequente à extinção da comunhão de bens entre os cônjuges, onde destacaremos as principais notas do Novo Regime Jurídico do Processo de Inventário (Lei n.º 23/2013, de 5 de março) e onde faremos a análise de duas questões que se levantam no âmbito do relacionamento dos bens, as quais geram controvérsia no nosso ordenamento jurídico e que poderão fragilizar a competência do Notário na resolução destes conflitos.
The judicial inventory process proceeding has always been the subject of harsh criticism, notably because it is particularly lengthy, damaging the effective and timely judicial protection of those involved in the sharing. In the framework of the legislator's freedom of legislative conformation, the latter understood that the best decision to take the rights and guarantees of the citizens and to enhance the procedural speed would be to deliver the conduct of the inventory processes to the notary. The object of our study is the sharing consequent to the extinction of the communion of goods between the spouses, where we will highlight the main notes of the new legal regime of the inventory process (Law n. º 23/2013, of March 5) and where we will analyze two issues that arise in the context of the relationship of goods, such as which generate controversy in our legal order and that may weaken the competence of the notary in the elucidation of conflicts of the mentioned nature.
