| dc.description.abstract | No contexto financeiro contemporâneo, os fundos de investimento mobiliário desempenham um papel crucial proporcionando aos investidores uma oportunidade valiosa de diversificação e participação no mercado que, de outra forma, estaria fora do alcance individual. Tendo em linha de conta a falta de personalidade jurídica distinta dos fundos de investimento mobiliário – que é, aliás, a sua pedra de toque – a identificação do beneficiário efetivo torna-se crucial para evitar opacidade e assegurar uma rastreabilidade efetiva destes veículos de investimento. Destarte, cumprirá a presente investigação abordar a dificuldade em identificar a possível identidade daqueles que, em última instância, colhem os benefícios das atividades dos fundos de investimento mobiliário, à luz dos métodos jurídicos indiciários previstos na legislação nacional. | pt_PT |
| dc.description.abstract | Within the contemporary financial context, mutual funds perform a crucial role by providing investors with an invaluable opportunity for diversification and market engagement that would otherwise be out of reach for them. Given the absence of a legal personality for mutual funds – which is, in fact, the cornerstone – the identification of the beneficial owner becomes crucial in order to avoid opacity and guarantee effective traceability of these investment vehicles. Accordingly, this research will address the difficulty of tracing the eventual identity of those who ultimately benefit from the activities of mutual funds, given the indicative legal methods provided by national legislation. | pt_PT |
