Durante a Pandemia Covid-19 os Estados adotaram várias medidas restritivas no domínio comercial, a pretexto de razões de saúde pública. Desde cedo, a União Europeia tentou conter tais medidas, mesmo entre Estados-Membros, passando a adotar medidas centralizadas. Apesar de os Regulamentos de Execução (UE) que instituíram o regime de autorização de exportações de equipamentos de proteção individual e vacinas cumprirem o estatuído no direito da União e nas regras da OMC, mais concretamente, o Acordo Geral sobre Tarifas e Comércio (GATT), que permitem uma ampla possibilidade de restrições económicas, tal deve ser reanalisado à luz de um novo conceito de solidariedade internacional.
During the Covid-19 pandemic, states adopted various restrictive trade measures under the pretext of public health. Early on, the European Union tried to contain such measures, even between member states, by adopting centralized measures. Although the Implementing Regulation (EU) that established the export authorization regime for exportation of personal protective equipment and vaccines comply with European Union law and WTO rules, more specifically, the General Agreement on Tariffs and Trade (GATT), which allow for a wide possibility of economic restrictions, this must be re-examined in light of a new concept of international solidarity.
