O despedimento coletivo e o despedimento por extinção do posto de trabalho configuram as modalidades mais relevantes do despedimento por motivos objetivos. Apesar de figuras semelhantes, os respetivos regimes jurídicos contam, ainda, com algumas diferenças estruturais, nomeadamente quanto à seleção dos trabalhadores a abranger pelo despedimento. Este trabalho visa analisar as vicissitudes provocadas pela aplicação prática destas modalidades de despedimento, assim como compreender as suas diferenças, ponderando a possibilidade de evolução para a sua regulamentação como uma figura unitária.
Collective dismissal and dismissal due to redundancy are the most prominent forms of dismissal for objective reasons. Although they are similar, the respective legal systems still have some structural differences, particularly regarding the selection of the workers to be covered by the dismissal. This paper aims to analyze the vicissitudes caused by the practical application of these forms of dismissal, as well as to understand their differences, considering the possibility of moving towards their regulation as a unitary figure.
