Na presente dissertação, tratamos de estudar o desdobramento de um fenómeno atual, com exponencial relevância no âmbito do Direito do Desporto, o match fixing. Concluindo e outorgando de forma inovadora, o elenco das modalidades em que se poderá consubstanciar o match fixing, justificamos ainda a preocupação pela tutela do bem jurídico, in casu, “verdade, lealdade e correção da competição desportiva”. O nosso propósito visa a sensibilização para o reconhecimento e distinção das diversas práticas desconformes.
Metodologicamente, relevamos as correntes doutrinais nas diversas matérias, (mormente da ética desportiva, bem como da interdependência de poderes públicos e privados para o combate cabal à prática de match fixing), sem olvidar jurisprudência e legislação, europeia e nacional, de natureza desportiva e penal extravagante.
In this dissertation, we try to study the unfolding of a current phenomenon, with exponential relevance in the field of Sports Law, the match fixing. Concluding and granting, in an innovative manner, the list of the modalities in which match fixing can be embodied, we also justify the concern for the legally protected interests, in casu, "truth, loyalty and correction of sports competition". Our purpose is to raise awareness for the recognition and distinction of the various non-conforming practices. Methodologically, we highlight the doctrinal currents in the various matters, (particularly the sports ethics, as well as the interdependence of public and private authorities for contest thoroughly against match fixing), without neglecting the case law and legislation, european and national, of sports and criminal extravagant nature.
