Abstract(s)
A presente dissertação incide sobre a responsabilidade penal das pessoas coletivas pelo crime de maus tratos (artigo 152º-A do Código Penal), tendo como vítimas as pessoas idosas institucionalizadas e como agentes as respetivas instituições. O intuito é analisar se a lei penal consagra todos os meios jurídicos necessários para combater os abusos e crimes cometidos por estas, quer intencionalmente, quer por força de violações de deveres de cuidado. Sendo assim, após a análise do tipo legal de maus tratos e da responsabilidade penal das pessoas coletivas no geral, é conclusivo que o Código Penal não se encontra apto para fazer face a todas as situações, uma vez que o seu artigo 11º, nº2 não permite responsabilizar as instituições, quando algum “subordinado” tenha praticado negligentemente condutas globalmente semelhantes às descritas no artigo 152º-A, ou não seja sequer possível individualizar o agente responsável pelas mesmas, tendo havido (ou não) a violação de deveres de cuidado por aquelas. Pelo exposto, recorremos ao estudo de outros ramos do direito, particularmente, o direito civil, e do direito comparado, com o intuito de averiguar a possibilidade de “transportar” para o ordenamento jurídico português, soluções de jure condendo.
.This thesis focuses on the corporate criminal liability for the crime of ill-treatment (article 152-A of the penal code), with institutionalized elderly people as victims and their institutions as agents. The aim is to analyze whether criminal law has all legal means necessary to combat abuses and crimes committed by them, intentionally or through breaches of care duties. Therefore, after analyzing the legal type of ill-treatment and corporate criminal liability in general, it is conclusive that the Penal Code is not able to deal with all situations, since article 11, nº2 does not make the organisation responsible, when a “subordinate” has negligently acted in conduct similar to the described in article 152-A, or it is not even possible to identify the agent of the offense, and there has been (or is not) a breach of duties of care of them. For all these reasons, we have studied other branches of law, particularly, civil law, and comparative law, in order to investigate the possibility of "transporting" solutions to the Portuguese legal system.
