| dc.description.abstract | Following the adoption of Directive (EU) 2024/1069 of the European Parliament and of the Council of 11 April, the main objective of this dissertation is to frame and explain the phenomenon of SLAPPs (Strategic Lawsuits Against Public Participation). The first part of this dissertation will be dedicated to the clarification of concepts and the historical and cultural framework of SLAPPs. This will be followed by a comparative law analysis of the impact of SLAPPs in other legal systems, along with an examination of Recommendation CM/Rec(2024)2 and Directive (EU) 2024/1069 of the European Parliament and of the Council of 11 April. This study will also focus on the relevant national legal provisions on the subject, as well as on the predominant legal scholarship concerning freedom of expression. | eng |
| dc.description.abstract | No seguimento da Diretiva da União Europeia 2024/1069 do Parlamento Europeu e do Conselho, de 11 de abril de 2024, a presente dissertação tem como principal objetivo enquadrar e explicar o fenómeno das SLAPPs (Strategic Lawsuits Against Public Participation). A primeira parte deste trabalho será dedicada à clarificação de conceitos e ao enquadramento histórico e cultural das SLAPPs. Em seguida, numa perspetiva de direito comparado, proceder-se-á à análise do impacto das SLAPPs noutros ordenamentos jurídicos e será realizada uma análise à Recomendação CM/Rec(2024)2 e à Diretiva da União Europeia 2024/1069 do Parlamento Europeu e do Conselho, de 11 de abril. Este estudo incidirá, ainda, sobre as normas internas relevantes sobre o tema, bem como sobre a doutrina mais predominante em matéria de liberdade de expressão. | por |
