Abstract(s)
A presente dissertação propõe-se a contribuir para a análise da temática da (in)admissibilidade probatória de mensagens enviadas por trabalhadores através da plataforma de mensagens instantâneas WhatsApp, para efeitos de aplicação da sanção disciplinar mais gravosa: o despedimento com justa causa. O exponencial crescimento da utilização do WhatsApp tem vindo a consolidar a sua relevância no contexto laboral, suscitando, como tal, desafios jurídicos que tendem a tornar-se cada vez mais frequentes. Partindo do difícil e inevitável confronto entre, por um lado, os direitos dos trabalhadores à reserva da intimidade da vida privada e à confidencialidade das comunicações privadas e, por outro, o poder de direção e direito de gestão do empregador, pretendemos, com esta investigação, aprofundar as questões subjacentes à admissibilidade desta prova digital, refletindo sobre os critérios que devem nortear a sua utilização no processo disciplinar laboral.
This dissertation aims to contribute to the analysis of the (in)admissibility of evidence in the form of messages sent by employees through the instant messaging platform WhatsApp, for the purpose of applying the most severe disciplinary sanction: dismissal with just cause. The exponential growth in the use of WhatsApp has been consolidating its relevance in the workplace context, thus raising legal challenges that are becoming increasingly frequent. Starting from the difficult and inevitable confrontation between, on the one hand, employees' rights to privacy and the confidentiality of private communications, and on the other, the employer's power of direction and management rights, this research seeks to deepen the underlying issues regarding the admissibility of this digital evidence, reflecting on the criteria that should guide its use in the labor disciplinary process.
