| dc.description.abstract | The Arctic is always in evidence, being at the same time unique, multifaceted, and extremely coveted. In recent decades, however, the discussions have the as premise only the projections on local climate mutations, while the effects of some international agreements affecting the Arctic are ignored or underestimated. In this context, repeated proposals have been made to mobilize the international community towards the elaboration of a treaty that would address the regional governance, as it was done for Antarctica, under the pretext that the Arctic countries, the international institutions and the current legal framework are ineffective in appeasing divergent interests. It is essential to go further, with broader premises, to use a qualitative methodology with the objective to identify and analyze the updated content of all international legal instruments relevant to the Arctic’s governance, assessing also how it is exercised, as a mean to verify the criticisms and proposed solution’s relevance. Reiterated examples were found of an ongoing cooperation between the Arctic countries, which exercise a regional governance that’s peculiar, but inspired in a Nordic tradition, correctly complying with the heterogeneous, and technically complex international legal framework in force, which is also observed by the competent international organisms. | eng |
| dc.description.abstract | O Ártico está sempre em evidência, sendo ao mesmo tempo singular, multifacetado e extremamente cobiçado. Nas últimas décadas, no entanto, as discussões têm como premissa apenas as projeções de mutações climáticas locais, ao mesmo tempo em que os efeitos de alguns acordos internacionais que incidem no Ártico são ignorados ou menosprezados. Neste contexto, reiteradas propostas são feitas para a mobilização da comunidade internacional em prol da elaboração de um tratado que venha a regrar a governança regional, tal como fez-se na Antártica, sob o pretexto de que os Países Árticos, as instituições internacionais e o arcabouço jurídico vigente são ineficazes para aplacar interesses divergentes. É imprescindível ir além, com premissas mais abrangentes, ao usar uma metodologia qualitativa com o objetivo de identificar e analisar o teor de todos os instrumentos jurídicos internacionais atuais e relevantes à governança do Ártico, apurando-se também a forma com a qual é exercida, como meio para se verificar a pertinência nas críticas e na solução proposta. Encontrou-se reiterados exemplos de cooperação contínua entre o AS, que exercem uma governança regional que é peculiar, mas espelhada numa tradição nórdica, cumprindo-se corretamente o heterogêneo, e tecnicamente complexo, arcabouço jurídico internacional vigente, o qual é também observado pelos órgãos internacionais competentes. | por |
