Abstract(s)
O presente trabalho tem como escopo responder a seguinte indagação: Até que ponto a Directiva Retorno torna o nacional de país terceiro em situação irregular, ou seja, o imigrante irregular, um inimigo? Essa indagação permite uma análise aprofundada do contexto histórico da Directiva (2008/115/CE) e do Direito Penal do Inimigo, além de um recorte sobre disposições do regramento, tais como a previsão de detenção e o regresso coercitivo do imigrante irregular para o seu Estado de origem que não é membro da União Europeia. Entender as questões e motivações da aprovação desse regramento jurídico, bem como, análise da figura do inimigo é essencial, tendo em vista que a Directiva busca equalizar a questão do retorno do imigrante irregular que são recebidos em diferentes dos Estados-Membros da União Europeia. Por fim, serão analisadas as novas propostas para alterações do regramento acerca da imigração irregular, como o Novo Pacto para as Migrações e Asilo.
The present dissertation intends to answer the following question: To what extent does the Return Directive becomes the irregular immigrant an enemy? This inquiry allows an in-depth analysis of the historical context of this Directive (2008/115/EC) and Criminal Law of the Enemy, as well as a clipping of provisions of this regulation, such as the provision for detention and expulsion of irregular immigrants back to their States outside the European Union. Understanding the issues and motivations of the approval of this legal rule, as well as analysis of the figure of the enemy is essential, whereas the Directive seeks to equalise the issue of the return of irregular immigrants who are received in different Member States of the European Union. Finally, will be analysed the new proposals for changes to the regulation on irregular immigration, such as the New Pact for Migration and Asylum.
