A presente dissertação incide sobre as relações estabelecidas no âmbito do investimento em capital de risco, mais concretamente quanto aos diversos e múltiplos interesses de cada parte. Após a compreensão do investimento em capital de risco como fenómeno económico e jurídico, traçam-se os interesses e os conflitos de interesses que surgem no seu âmbito, salientando-se a existência dos conflitos de interesses como uma idiossincrasia do capital de risco. Visto que o financiamento através do capital de risco é uma forma de financiamento empresarial de extrema importância, enumeram-se soluções existentes na ordem jurídica para aquele que vê o seu interesse lesado aquando de um conflito de interesses.
This dissertation focuses on the relationships established within the scope of private equity deals, more specifically regarding the diverse and multiple interests of each party. After understanding private equity deals as an economic and legal phenomenon, the interests and conflicts of interests that arise in its scope are outlined, emphasizing the existence of conflicts of interest as an idiosyncrasy of private equity. Since financing through private equity is an extremely important form of corporate financing, the solutions available in the legal system are listed for those whose interests are harmed in the event of a conflict of interest.
