A violência de género é um problema social e jurídico que tem sido objeto de debate e discussão em todo o mundo. Em Portugal, a relação entre a violência de género e o direito penal tem evoluído ao longo dos anos, refletindo as mudanças na sociedade e no papel da mulher. Esta dissertação de mestrado abordará tópicos como a evolução histórica do papel da mulher no direito, as teorias feministas do direito, o feminicídio, a violência obstétrica e a discriminação positiva, focando-se na possível pertinência de legislação específica e a sua efetividade na reversão das condições que motivam a violência contra as mulheres. Através de uma análise detalhada da lei penal portuguesa procurámos abordar estes tópicos e relacioná-los com a questão da violência de género em Portugal e as medidas necessárias para a erradicar.

In Portugal, the relationship between gender-based violence and criminal law has evolved over the years, reflecting changes in society and the role of women. This master’s dissertation will address topics such as the historical evolution of the role of women in the law, femicide, obstetric violence, and positive discrimination, focusing on the relevance of specific legislation and its effectiveness in reversing the conditions that motivate violence against women. Through a detailed analysis of the Portuguese criminal law topics, we aim to provide a comprehensive view on those topics and the correlation between them and the issue of gender-based violence in Portugal and the necessary measures to eradicate it.
