| dc.description.abstract | A presente dissertação terá como principal objetivo desenvolver o tema do empty creditor. Tendo em conta que o direito comercial se encontra em constante mutação e a cada dia surgem novos desafios, decidimos que não podemos deixar de reconhecer a importância do tema, uma vez que é uma figura cada vez mais frequente, nomeadamente no que concerne ao financiamento das sociedades. Na verdade, o financiamento de sociedades através de derivados de crédito como os credit default swaps tem vindo a aumentar e em virtude deste aumento surgem novos desafios, para os quais a lei não tem uma solução clara, como é o caso do papel credor vazio no financiamento das sociedades. Sendo assim, o objeto do nosso trabalho será, especificar a influência que o empty creditor tem dentro da sociedade e formas de mitigar os seus efeitos, procurando ao mesmo tempo abordar possíveis vias de responsabilização para estes credores. | pt_PT |
| dc.description.abstract | This dissertation will have as main objective to develop the theme of the empty creditor. Taking into account that the law is constantly changing and every day new challenges arise, we decided that we must recognise the importance of the topic, since it is an increasingly common figure, particularly with regard to the financing of companies. In fact, the financing of companies through credit derivatives such as credit default swaps has increased and as a result of this increase emerge new challenges, for which the law does not have a clear solution, as is the case of the empty creditor role in corporate financing. Therefore, the object of our work will specify the influence that the empty creditor has within society and ways to mitigate their effects, looking at the same time addressing possible avenues of accountability to these creditors. | en_EN |
