Abstract(s)
O incumprimento dos acordos relativos ao exercício das responsabilidades parentais após o divórcio é uma realidade. Esta realidade tem-se traduzido no recurso aos tribunais, mediante a apresentação do requerimento do incidente de incumprimento. É uma matéria sensível e, por isso, merece a nossa melhor atenção. Estão previstas e reguladas no art.41º do RGPTC todas as sanções que advêm deste incumprimento. Atualmente, no quadro das relações familiares, o incumprimento do exercício das responsabilidades tem-se verificado essencialmente na vertente do regime de visitas. O progenitor residente opõe-se e manipula o filho, com o intuito de afetar gravemente os laços afetivos com o outro progenitor, impedindo os contactos entre ambos. A este tipo de comportamento designa-se por “alienação parental”.
Importa, ao longo deste trabalho de investigação debruçar-me sobre o conteúdo das responsabilidades parentais e sobre os princípios que norteiam o seu exercício, mormente o princípio do superior interesse da criança. É, por isso, necessário compreender até que ponto a alienação parental, num anterior contexto familiar estável, não coloca em causa este princípio. Por fim, o caso concreto: o confronto entre as sanções aplicadas ao caso aquando do incidente de incumprimento e a eficácia da aplicação desses meios coercivos, de modo a evitar novos incidentes.
Failure to fulfill agréments relating to the parental responsibilities after divorce is a reality. This reality has resulted in recourse to the courts, upon presentation of the application, of the non-compliance incident. It's a sensitive subject and, therefore, deserves our best atention. All the consequences of this non-compliance are foreseen and regulated in article 41 of the RGPTC (Regime Geral do Processo Tutelar Cível, in portuguese). Currently, within family relations, the failure of the responsibilities has been occurring essentially in terms of the visitations. The resident parent opposes and handles the son, in order to severely affect the affective ties with the other parent, preventing contacts between both. This kind of behavior is called "parental alienation". It is important during this research work to study the content of the parental responsibilities as well its principles, especially the principle of the child’s best interest. It is therefore necessary to understand to what extent parental alienation in an previous stable family context does not call into question this principle. Finally, the concrete case. The comparison between the sanctiones applied to this case in incidents of non-compliance, and the effectiveness of the enforcement of such coercive measures in order to avoid further incidents.
