Os Contratos de Prestação de Serviços assumem grande destaque na sociedade moderna, uma vez que se apresentam em variadas disciplinas do direito. Devido às inúmeras matérias que abrangem, dispomo-nos a analisar de uma maneira geral, os interesses das partes do contrato e aquilo a que estão sujeitas por força deste, assim falaremos da distribuição do risco. O Risco nos Contratos de Prestação de Serviços é a ocorrência de um evento, fora da vontade das partes, que pode acarretar para cada uma delas maior onerosidade ou dificuldade no cumprimento do contrato, ou até levar à sua impossibilidade. O trabalho orienta-se através das normas relativas à Impossibilidade Não Imputável ao Devedor, tendo em consideração a falta de normas regentes do risco aplicáveis apenas a estes contratos. Assim teremos oportunidade de analisar a impossibilidade da prestação quando estamos perante uma impossibilidade definitiva, temporária, ou quando o seu cumprimento é defeituoso e ainda a impossibilidade da prestação como um resultado. Cremos que esta análise nos permitirá refletir e entender melhor sobre as vicissitudes inerentes à posição contratual.
The Service Contracts assume a great prominence in the modern society, since they present themselves in multiple disciplines of the law. Due to the many subjects they cover, we propose the analysis of the interests of the parties in the contract and to what they are obliged by virtue of it, therefore we will herein focus on the discussion regarding the distribution of risk. The Risk in Service Contract is the occurrence of an event, outside the will of the parties, which can cause for each of them greater onerousness or difficulty in fulfilling the contract, or even lead to its impossibility. The work is guided by the rules on the Non-Impossible Impossibility of the Debtor, taking into account the lack of rules governing the risk applicable only to these contracts. For this matter, we will have the opportunity to analyze the impossibility of the provision when we are faced with a definitive, temporary impossibility, or ever when its compliance is defective and still the impossibility of the provision as a result. We believe that this analysis will allow us to reflect and clearly understand the instability inherent to the contractual position.
