O presente trabalho trata da análise às limitações da política de concorrência relativamente ao combate aos cartéis na União Europeia. Partindo da análise dos objetivos da lei da concorrência e do conceito de cartel, bem como da sua proibição pelo direito da concorrência, é efetuada uma reflexão sobre as medidas adotadas pelas autoridades da concorrência na prevenção de comportamentos anticoncorrenciais e sobre a sua eficácia na dissuasão dos comportamentos ilícitos. Através de um estudo doutrinal, é também efetuada uma análise de mecanismos que poderiam contribuir para melhorar a dissuasão e, consequentemente, conduzir a uma diminuição do aparecimento de cartéis.
This work seeks to analyse the limitations of the antitrust policy in the fight against cartels in the European Union. Starting from the analysis of the antitrust objectives and the concept of cartel, as so its prohibition by the competition law, a reflection regarding the measures adopted by the antitrust authorities in the prevention of antitrust violations is conducted, and its efficiency in deterring unlawful behaviours evaluated. Furthermore, an analysis of different mechanisms that could be employed to extinguish cartel activity is performed, with the support of a thoroughly literature review.
