A presente dissertação destina-se ao estudo do tema da violência obstétrica, tomando por base os resultados de estudos nacionais e internacionais. Estamos perante um fenómeno atual que também ocorre nos hospitais portugueses, onde são realizados atos sem consentimento prévio e em violação das leges artis. Pretende-se analisar o tema à luz da responsabilidade civil médica, tanto contratual como extracontratual, fazendo ainda menção à possibilidade de legislação especifica sobre o tema que permita uma maior proteção das grávidas no momento do parto.
The following dissertation proposes an analysis of the theme of obstetric violence, going from the result of national and international studies. It is an ongoing phenomenon that occurs at the national hospitals, where there are practices done without the informed consent and in violation of leges artis. This study aims to analysis within the scope of medical civil liability, contractual and extracontractual. Touching also on the possibility of specific legislation about this topic that seeks further protection of pregnant women during childbirth.
