Abstract(s)
A presente dissertação de mestrado visa analisar a conformidade do artigo 348.º do Código do Trabalho, face ao princípio da igualdade e da não discriminação em razão da idade dos trabalhadores mais velhos.
Os dois princípios irão ser estudados tendo em conta a Diretiva 78/2000 que estabelece um quadro geral de igualdade de tratamento no emprego e na atividade profissional, bem como a jurisprudência do Tribunal de Justiça
Ademais, o artigo 348.º, CT tem vindo a suscitar alguns problemas doutrinas que, também, serão aqui discutidos.
The following Master dissertation aims to analyze the compliance of the article 348. º of the Labor Code, taking in consideration the principle of equality and non-discrimination on grounds of age of older workers. The two principles will be studied in the light of Directive 78/2000, establishing a general framework for equal treatment in employment and occupation, as well as the case law of the Court of Justice. . Furthermore, the article 348. º, Labour Code has been raising some doctrinal problems that will also be discussed here.
