O artigo tem por objecto a figura do contrato administrativo, tal como ela resulta do novo Código dos Contratos Públicos. Com efeito, o novo Código procedeu à delimitação da figura do contrato administrativo em termos inovadores, suscitando questões. que justificam especial atenção, atendendo à relevância do regime jurídico substantivo que a Parte III do Código faz corresponder à figura. Partindo dos antecedentes legislativos e doutrinais sobre a matéria, o autor procede, pois, neste artigo, à identificação das categorias de situações contratuais que, em sua opinião, devem ser qualificadas como administrativas e à análise da questão do respectivo enquadramento no regime substantivo introduzido pelo Código dos Contratos Públicos.
This article concerns the administrative contract figure, as it results from the new Public Contracts Code. As a matter of fact, the new Code has carried out the delimitation of the administrative contract figure in innovative ways, posing questions worthy of special attention, given the relevance of the substantive legal regime that Part III of the Code assigns to the figure. Building on legislative and doctrinal background, the author shall, therefore, in this article, carry out the identification of contractual situations categories — which, in his opinion, should be regarded as administrative — and the analysis of the issue of the respective framing in the substantive regime introduced by Public Contracts Code.
